Peter
Rape wrote his last will and testament on 12 Aug 1824. The will was
recorded in Mecklenburg county Will Book F p 138. The recorded version of
the will appears in 'The Rape Family Tree.' Presented below are the
words as appearing in the original and unbound version of the will. The
reader will note some differences in spelling and of particular interest
is the name of Peter's son, Israel. He was in truth "Israel Bradox
Rape," not Israel Braden.

In the name of God, Amen. I, Peter Rape Senior, being weak in body
but of a sound disposing mind & memory (Blessed be God.) Calling to
mind the mortality of the body and that “It is appointed unto all men
once to die’ do make & ordain this my Last Will and Testament in
manner and form following Viz.
First I commend my soul to God who give it, and my
body to the earh to be buried in a decent and Christian like manner at the
discretion of my Executore.
Second with regard to such worldly estate as it hath
pleased God to bless me with, I desire that all my just debts and funeral
expences be first paid as soon as convenient after my decease.
Third, I give, devise & bequeath unto my only &
beloved wife, Polly, her bed & its furniture, two wheels, one learge
& one small and one pair of cards, two chests & four chairs, my
cupboard & its furniture, my mare, Trim, her saddle & bridle, two
plougs, one gopher & one bar share and one set of plough tacklings –
also tow cows & calves, her choice out of my flock and all my sheep,
hogs & poultry be there more or less – with all the before mentioned
property, I do hereby confirm unto her, Polly, my wife as afore sd. To be
for her use & to be disposed at her discretion during her natural life
and what of it remains at her death to be sold & devided equally
amongst all my children.
Fourth, I give devise & bequeath unto my daughter,
Mary Ann, her bed and furniture, her spinning wheel and cards & two
chairs & once cow & calf.
Fifth I give devise & bequeath to my son, Israel
Bradox, one horse saddle & bridle & one bed & furniture.
Sixth, I give devise & bequeath unto my son,
William Howard, one bed & furniture.
Seventh, I give devise & bequeath to my son,
Gustavus, one bed & furniture.
Eight, It is my desire that the land on which I now
live be devided into three equal parts by the direction of two
commissioners & the county surveyor quantity & quality taken into
view & a value to be esteemated upon it by them and that third part
which shall contain the dwelling house & spring to beo the possession
of my wife, Polly, during her life & at her death to go to her son
Israel B. on condition that he pay unto the rest of his brothers &
sisters their proportionable part of the value esteemated upon it.
Ninth, it is my will that the remaining two parts of my
land be given to my tow sons, William H. & Gustavus by lot on
condition that they & each of them pay unto all their borthers &
sisters their proportionable part of the value esteemated upon it. It
being my will to give each of my children an dqual proportion of my
worldly estate.
But if either of my three sons to whom I have give my
land dislike the conditions on which it is given to them then his part
will have to put to sale to the highest bidder & the money arising
therefrom be devided as before said and I hereby authorize my Executors to
make a good lawful and sufficient title or deed of sale for the same as
much as I myself could if I were still alive.
And further I do hereby nominate and appoint my two
oldest sons Peter & John Rape to the Executors of this my Last Will
and Testament.
And I do hereby abjure and annul all form wills by me
hereto fore made and declare tis to contain all my will relating to such
matters as are mentioned therein – In Testamony where of I have here in
the presence of us
